The Flint Ethics and Accountability Board filed a Complaint against the City Council in the Genesee County Circuit Court on Monday, December 2, 2024. The Complaint requests the Court to compel the City Council to fill the vacant Third Ward Council Seat immediately. This action was taken by the Ethics and Accountability Board to protect the rights and interests of the citizens of the City of Flint.
On September 29, 2024, Councilman Quincy Murphy passed away, creating a vacancy in the Third Ward council seat. The City Charter required the City Council to appoint a person to fill this vacancy by October 29, 2024. The City Council failed to meet this deadline, and has refused to respond to requests from the Ethics and Accountability Board urging them to make the required appointment. This inaction has left the citizens of the Third Ward without a representative on the City Council.
This violation of the City Charter by the City Council has resulted in a stalemate of City Council actions that are necessary for the City of Flint to function properly.
The Ethics and Accountability Board is charged with overseeing and ensuring compliance with the Flint City Charter. This responsibility includes pursuing any necessary remedial actions such as legal remedies before a court. The case filed against the Flint Council recently fulfills the responsibilities of the Ethics and
Accountability Board to the citizens of Flint.
The Hon. Elizabeth Kelly has signed an Ex-parte Order to Show Cause and has scheduled a hearing date for Defendants to appear and address the issue at 11 a.m. on December 11, 2024. The EAB stated they are hopeful the Flint City Council members will seriously consider this litigation, put aside personal grievances and do all things necessary to work together and comply with the Flint City Charter. Continued non-
compliance will have legal consequences, up to and including the possibility of being held in contempt of court and facing jail time.
